GW loses IP case; neckbeards everywhere point and laugh
Re: GW loses IP case; neckbeards everywhere point and laugh
GW don't own the fantasy mini genre so I don't see a problem with them producing minis that GW haven't got around to doing yet. It's a bit like if the Tolkien Society, HR Giger or Ridley Scott suddenly decided to take GW to court for ripping off all of those ideas from fantasy and sci-fi.
Forget about yesterday, don't worry about tomorrow because all that matters is today.

How about if GW made minis of Gigers creations using images lifted from his art, called them Giger's Aliens and told HR Giger to go screw himself? Would it be ok?ashmie wrote:GW don't own the fantasy mini genre so I don't see a problem with them producing minis that GW haven't got around to doing yet. Because that is what CH did. They opened the Nid Codex, looked at the artwork, sculpted a model and then advertised it using the name from the book. It wasnt generic or vague at all.

You mean the aliens that come in the Space Wreck board game?

while there are similarities between the giger aliens and genestealers, there's sufficient difference between this:

and this: (the original genestealer design from 20 years ago)

or this: (a current space hulk 'stealer)

Sure, they're both bipedal gribbly monstery things, but there are significant differences (number of arms, for starters, head is clearly different, etc.) I don't think anybody would argue that genestealers weren't influenced by Giger's aliens, and in fact I'm pretty sure the designer is quoted as saying so, but there are sufficient physical differences to distance the two IPs. Genestealers also have a large amount of fluff and backstory. Books and books of it, in fact. Patriarchs, Ymargl, Tyranids, cults etc etc. I think GW can safely say "we made genestealers."
CHS, otoh, have looked at this: (a farseer, who has spell called doom. Theyre commonly called doomseers because of this.)

and made this: (a doomseer i.e. a farseer with tits.)

or this: (a striking scorpion exarch, a kind of warrior priest who tends a shrine)

and made this: (a scorpion warrior priestess. i.e. an exarch with tits.)

The striking scorpion exarch comes with a double handed chainsword, too, btw.
They also do a string of models which are specifically aimed at replacing or converting GW parts. e.g.

That jetbike is an actual GW model, not a CHS model. The bits sticking off the side and the mini riding the bike are CHS. Note the name: Farseer Jetbike conversion kit. GW have copyright on the word Farseer, as applied to a mystic alien elfy dude who can see the future. (Incidentally, does that guy seem familar?)
CHS arent innovating, designing, or producing anything new. They are stealing ideas. That is all.

Fair enough, nit picking aside though GW wouldn't be anyway with their ideas without Tolkien, Giger, a handful of sci fi writers and Lovecraft. Anyway this will be my second to last post for a while until I have something worthwhile to say as I hate being disagreed with over little things all the time as I've mentioned before so until I have something constructive and worthwhile to say I'm going to keep quiet on here for a while.

Ah, but the CHS model is holding the spear in the opposite hand to yours. Sorry, but I dont think you have a case there. At least, thast what CHS said when they sold the "Copy of M_i_J's conversion Farseer Kit" on their site.

Re: GW loses IP case; neckbeards everywhere point and laugh
I always thought Tyrannids were basically the tabletop version of Starship Troopers bugs. I'm with you, though. I have no problem with other companies targeting Warhammer players with their own version of GW models. It's petty rare for them to produce sculpts that can compete with GW's anyway. (I regret buying Reaper's tree kin substitutes, for example.)ashmie wrote:Fair enough, nit picking aside though GW wouldn't be anyway with their ideas without Tolkien, Giger, a handful of sci fi writers and Lovecraft.
