My wife was in a car that was hit by a drunk driver who jumped a red light while going down the wrong side of a road (with a big central partition as well, so it was clearly the wrong side). The driver of the car she was in was found 10% to blame when it came to working out insurance claims.

Essentially, if you are in an accident you are partly to blame for being present at the accident. :roll:

I actually hate to say this, but I think that might be best for society. Certainly it must have felt wrong for Prim's wife and friend, but coming from a super litigious and lawsuit happy society like America, maybe it puts a healthy sense of common responsibility, rather than painting everything in black and white terms. Afterall, through the social medical system we all will be paying part of the medical expenses of this accident.

Nevertheless it doesn't shift blame in my mind for the accident. Best wishes to MiJ.

The actual resolution will be weeks away, I suspect, but from what I've been told by a number of reliable sources (the car repair company who deal with insurance repairs every day) and the website of our own insurance company, if your car is stationary and you are hit in the rear, it's 100% the other guy's fault. Now, we haven't been told that by our insurance company officially, because of course they need to look at all the paperwork and stuff before they say a single word to us regarding likely outcomes, but I'm somewhat optimistic about being in the clear. It wouldn't kill me to pay 10% or whatever, I mean, I actually have pretty good insurance cover, but both my wife and I are unhappy about him changing his story to save his own ass, so we're inclined to gun for the truth as much as possible. If the insurance companies deem it necessary for us to pay then fairly do's, but we will not capitulate to this other guy just to save him some money. Even the fact that he called us last night to suggest that we pay for his car if he pays for ours smacks of trying to weasel out of what he should be doing. No sir, I don't like it. :evil:

It does take a bit of time mate.

I think you have the right attitude. Insurance companies will outright lie to you so as to avoid paying up. In my case, the insurance guy for the bloke who hit me came to the hospital and lied to me while I was sitting in a wheelchair with both arms in slings, covered in my own blood, about what he could and couldnt pay.

My wife spent a lot of time checking up on exactly what the insurance company was required to pay, and got everything we were owed.

Get Kaz to do her research, and don't let the slippery bastard get away with anything!

Well, did he say that he has hit rock bottom and that he is terribly sorry for his hazardous and irresponsible driving? Did he thank you for your calm response and not getting out of your car and screaming at him? Did he say his rent is due and there is a baby on the way or some such?

If not...No sir, it is not to like!

Today my Tyranid Hive Queen's antennae fell off while I was awakening her :o :( I hope to get all my Tyraninds done by the end of July or maybe in August. I think I will put finishing my Eldar and Raptors off for a bit longer. Nagoya needs some Aliens, even if most of them will end up in Alien heaven ;)

@MiJ: The guy calls your house offering to split the cost for what he is responsible for? He is a real bastard.

Tonight, there's no World Cup game to interfere, so I will be working on my Daemon Prince before bed.

Just curious MiJ, but what exactly was his excuse for hitting a stationary vehicle? :roll: Apart from the truth of course which was probably using smart phone, TV, changing of CD, looking out the window at a cute girl, angry passenger telling him he should have turned left two blocks back...etc.

@MiJ, what douchebaggery! I suppose the fact that he's trying to circumvent the process in this way suggests he knows full well he's to blame and is probably going to have to pay the lions share. Panic mode. Maybe that's a good sign if anything. A real irritation, but strong reasons to think it'll work out in your favour.

Played a fair bit with the boy and my wife, and spent a bit of time today looking at the Ork codex and trying to put lists together in the Quartermaster app (You all probably have it- but, fantastic). Very hard to put together something satisfying to be honest, especially at low points. With mob rule, the codex really seems like it's railroading the player into taking lots of large mobs on foot, which of course leaves very little for the shiny new fun stuff. I realise that that's just one of the qualities of the orks, take it or leave it, but I want to explore a more speed freaky vehicles and transports type thang. I could put 20 shootas in a battlewagon, but then i lose a nice heavy support slot. Ah well. Maybe I'll just start with 3x 10 gretchin for my core and go from there!

Made some slightly piecemeal progress on a unit each of elves and goblins for Battle of 5 Armies, plus a hero for each army. Curse the weather for not letting me prime something I really want to paint! :lol:
